8 SectionA Gannett Westchester Newspapers Monday July 27 1981 Obituaries Study calls for changes obituaries in county police force By MICHAEL ZUCKERMAN Staff Writer A police consulting firm released a 4 month study of the county police this morning in which it recommended a series of changes in state and local laws that created the 2 year old agency Key among the recommendations contained in the 216 page report were increases in civilian staffing in the de partment creation of a single building to house the police fire and civil defense agency and changes in laws that would give police officer status to members of the department who currently lack that status for pension purposes The report also recommended abol ishing the Police Advisory Board to allow more direct communication be tween the county executive and the commissioner of the Westchester De partment of Public Safety Services The study held that such an advisory board had seriously interfered with the ability of the commissioner and county exec utive to work together for the interests of the department The Police Executive Research rum (PER) of Washington a presti gious consultant group hired by the county made several dozen recommen UNDS dations to improve the Westchester De partment of Public Safety Services Problems at the agency were re vealed by the public dispute between County Executive Alfred DelBello and suspended CommissionerSheriff Thom as Delaney The police agency was formed by a merger of the Westchester Parkway Police and the De partment Recommendations disclosed in the report issued today included: Establishing a uniform rank and pay structure Developing a clearer means of disciplining or removing the commissio nersheriff Changing the name of the com missionersheriff to just Changing the name of the agency to the Westchester Public Safety De partment Dr Gerald Lynch president of John Jay College of Criminal Justice and head of the Public Safety Services Ad ministrative Review Task orce made the professional study public today The study is an attempt by the county to find ways to improve the structure and operational ability Continued from page one But County Executive Alfred DelBel lo said that is turning this into a political issue when it is only a legal problem which could have been rectified by act of the Board of Legis lators at any time since last DelBello said he suggested that the Board the inconsistencies in the The latest development in the Dela ney DelBello clash comes as a county task force assigned to review a break down in the operations of Public Safety Services department is preparing to release its findings The board chairman said he thought the ban on payments for de fense was an attempt to get the legis lature involved in what essentially was a political fight between DelBello and Delaney Such involvement indicated could cripple its effectiveness as an appellate body in the Delaney case later said further that he would try to prevent payments to the counsel hired by DelBello in discipli nary hearing unless the ousted commis lawyer also is paid seems to me DelBello has enough trouble with Delaney without taking on the Board of said Delaney is being tried on 42 adminis trative charges of misconduct lodged last ebruary by DelBello In April the board authorized the county to pay Dela legal fees up to $25000 DelBello returned the legislation un signed with the comment that he thought it was inconsistent with another county law on the subject of providing legal assistance for county officers He recom mended rectifying the inconsistency But by not signing or vetoing the bill DelBello allowed its enactment said and no new legislation was passed Last May before the administrative hearings began attorney Ju lius Cohn received $13250 in fees An other claim was submitted this month In a letter dated July 23 Shulman told Cohn he could not honor the law claim for an additional $11850 because county attorney Samuel Yasgur believed the legislation authorizing the payments was to Shulman said he and Yasgur agreed to get an opinion on the legality of the payments from New York comp troller No payments will be made until the opinion is received the finance com missioner said memo prompting the ban stated: I do not want to do anything that might arguably give the appearance of hindering Mr effort to assemble a defense I suggest this is a matter in which the opinion of the state comptroller should be Shulman said in his letter that a ruling by the state against Cohn would mean the lawyer would have to refund the payments already made to him Cohn would not comment on the letter on the other hand said Shulman had no right as a commissioner to overrule duly enacted legsiation expressed the suspicion that the ban on payments was an at tempt to get the legislature involved in what was a politcal fight between Del Bello and Delaney If the board gets too involved at this stage said it will be prevent ed from reviewing findings and the punishment he gives to Delaney A hearing officer is hearing testimo ny in the case and will report his find ings to DelBello who is charged with making the determination and punish ment The Board of Legislators has the appeal jurisdiction Meanwhile the report of the blue ribbon panel appointed by DelBello months in the making is to be made public today and is expected to criticize past practices of the department and make recommendations for legislation to correct weaknesses in the two year old county agency On his final day a witness last week Delaney made a full admission to one of the charges he faces which accused him of denigrating the task force by calling it kangaroo TAX Continued from page one still not in final form Baker
